MS being sued over XBL charges - Nov 15, 2007 05:46

Microsoft is being taken to court in a class action law suit, but believe it or not, it has nothing to do with Red Rings of Death. According to Gamasutra, Georgia resident Francisco Garcia claims in 2005 Microsoft allowed his underage son to use his debit card to purchase a year subscription to Xbox Live without his consent, and then automatically renewed the subscription a year later without authorization.

Garcia claims the automatic renewal put his checking account into overdraft, for which he received a $35 penalty from the bank. Microsoft refunded the $50 XBL renewal fee, but not the $35 penalty. Garcia is now seeking unspecified damages, contending that by allowing his son to purchase an account without his consent, Microsoft " fraudulently induced a contractual relationship for Xbox Live services." Microsoft, however, claims Garcia' s son falsely stated he was 18 when he purchased the subscriptions, and they say they have paperwork to prove it.

The action was filed in August of this year and moved to federal court in September. Garcia is looking to broaden the case to include anyone in Georgia who has faced the same issue, while Microsoft is, of course, seeking to have the case dismissed. It ain' t exactly Silicon Knights v. Epic Games, but we' ll keep you posted on further developments as they happen.

Instead of trying to be a good parent, I' m just going to sue the biggest company I can find to cover up my parental failings. Yeah. That' ll teach em.

Therefore you would end up with the same overdraft scenario and be reduced to filing a silly lawsuit a couple of years later. GAME OVER!

That just sounds poor.
